S-W Floor Cover Shop v. National Council on Compensation Insurance

Oregon Supreme Court

Decided April 14, 1994No. DIF 90-10-009; CA A74356; SC S40585PublishedCited by 50 opinions

1Opinion of the CourtVan Hoomissen, J.

This case requires the court to determine how the statutory definition of “independent contractor” found in ORS 670.600, enacted in 1989, has affected statutory provisions for determining when a person is subject to Oregon’s workers’ compensation law, ORS chapter 656.

SAIF Corporation, petitioner on review, asks this court to reverse the Court of Appeals’ determination in this case that the legislative creation of a statutory definition of independent contractor replaced the judicially created “right to control” test for determining workers’ compensation coverage.
