This is an appeal by plaintiff from a judgment given in favor of defendant on sustaining a demurrer to the complaint. The facts of the case, as shown by the complaint, are as follows: Plaintiff and defendant were opposing candidates for the office of sheriff of Butte County at the general election held November 4, 1902. On the official canvass of the returns of said election, defendant was found to have received the highest number of votes and was declared elected, and a certificate of such election was regularly issued to him on November 22, 1902.
