This matter is before the Court on a motion to dismiss (Dkt. # 7) filed- by Defendant Hilda L. Solis, Secretary of the United States Department of Labor (“Sec*35retary”). The Secretary moves to dismiss the claim under Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6), arguing that this Court lacks subject-matter jurisdiction or, in the alternative, Plaintiff Norfolk Southern Railway Company (“NSR”) has failed to state a claim.
