Defendant was convicted of murder in the first degree and sentenced to death. He appeals from the judgment and the order overruling his motion for new trial. At the time he is alleged to have committed the crime (December 19, 1921) he *6was, and had been for some four months, an inmate of the Industrial School, an institution for the confinement of neglected, dependent, incorrigible, and delinquent children under the age of eighteen years.
