MEMORANDUM AND ORDER ON DEFENDANT’S MOTION TO DISMISS THE INFORMATION

ROBSON, District Judge.

The information in this criminal prosecution charges the defendant, Inter-lake Steel Corporation, with discharging iron particles and an oily substance into the Little Calumet River on June 3, 1968, in violation of Section 13 of the Rivers and Harbors Act of 1899. 33 U.S.C. § 407. The defendant has moved this court to dismiss the information on three grounds. For the reasons set forth below, this court is of the opinion that the motion should be denied.
