Appeal from a judgment of the Superior Court of the city and county of San Francisco. The facts are stated in the opinion of the court.

This action is brought to recover $441.36, with interest, under an act of the legislature, entitled *117“An act to require the payment of certain premiums to counties and cities and counties by fire insurance companies not organized under the laws of California, but doing business therein, and providing for the disposition of such premiums,” approved March 3,1885. (Stats. 1885, c. 15.)

An answer was filed to the complaint, and thereupon, on motion, judgment was rendered for the plaintiff on the pleadings, from which defendant appeals.
