On November 1, 1927, the respondents Wallis, being then the owners of certain real property situated in the city of Seattle, contracted to sell the property to the appellant, Elliott, at a price of $5,500. Elliott, at the time of the execution of the contract, paid $1,000 in cash on the purchase price, assumed and agreed to pay a mortgage of $2,600 then a lien on the property, and agreed to pay the remainder of the purchase price, $1,900, in monthly instalments of $35 eaeh, the payments tó be made on the first day of each and every month. Elliott made the instalment payments as they matured…
