SULLIVAN, Chief Judge:

On July 29, 1992, this Court issued an opinion in this case (34 MJ 319, 324) setting aside the decision of the Court of Military Review (32 MJ 567 (1991)) and remanding *449the record to that court for further review. On January 15, 1993, the Court of Military Review issued a second opinion in this case, again affirming the findings and sentence. 36 MJ 754. On September 21, 1993, this Court specified two issues for consideration, as follows:
