On December 16,1918, Mitsui & Company delivered to the United States Railroad Administrator (Great Northern Railroad) at Everett, Washington, a privately owned tank car containing soya bean oil consigned to the American Cotton Oil Com*26pany at Chicago. This action, was brought to recover damages for the non-delivery of that shipment. The complaint is in the usual form in such cases. The answer admits the receipt and non-delivery of the shipment and contains appropiate denials of other things stated in the complaint, and then affirmatively alleges:
