This is an action to recover damages for the alleged failure of the defendant to send notice of protest for nonpayment to the indorsers on a note of which the plaintiff was a holder through the indorsement of the payee. The case was heard by a judge of the Superior Court, without a jury, who made certain findings of fact, rulings of law and found for the plaintiff in the sum of $2,500 as damages.
