The defendants in error were partners doing business in Chicago under the name of Charles P. Kellogg & Co. The plaintiffs in error were partners doing business as bankers in Hooper, in this state, under the name of the State Bank of Hooper, and will hereafter be called the bank. H. H. Looscben was a merchant in Hooper, who *562in February, 1891, was indebted to Kellogg & Co. in the sum of $704.50.
