This is an appeal by the defendant from a final decree entered in a suit in equity adjudicating that the defendant was indebted to the plaintiff in a certain amount which the defendant was ordered to pay with interest and costs.
The defendant contends that there was error in overruling its demurrer. If we assume without deciding that the sufficiency of the bill is open on a final decree although no appeal was taken from the decree overruling the demurrer, it is plain that the bill set forth a case within equity jurisdiction.
