Pending is the plaintiff’s motion for summary judgment. The plaintiff, Theodore J. Mayer (“Mayer”), was found entitled to indemnification for the fees and expenses he incurred in his successful defense of a lawsuit brought against him in Chicago, Illinois. The issue is whether Mayer may now recover against the corporation, Executive Telecard, Ltd. (“Executive Telecard”), the attorneys fees he incurred in prosecuting this Delaware indemnification action to a successful conclusion.
