MEMORANDUM AND ORDER

Plaintiff, Virgin Islands Telephone Corporation, on January 13,1977, filed a motion to allow the late filing of a claim against the Government of the Virgin Islands pursuant to 33 V.I.C. §§ 3408-3414, the Virgin Islands Tort Claims Act. In response, the Government on February 15, 1977, filed a “Motion” to deny the relief prayed for by Vitelco alleging that the plaintiff has failed to affirmatively meet all three requirements of 33 V.I.C. § 3409, the section upon which plaintiff’s motion is founded.
