OPINION

I. INTRODUCTION

Once again this court is called upon to resolve a question of jurisdictional limitation under the Virgin Islands Tort Claims Act, 33 V.I.C. § 3408 et seq. (1981 Supp.) (Act). The defendant has moved to dismiss the complaint on the ground that plaintiff has failed to comply with the procedural requirements of the Act, thereby denying subject matter jurisdiction to the court.
