This is the second appeal of this case. 295 S. W. 234. The cause was tried upon appellee’s second amended petition, filed after the case was reversed. Ap-pellee alleged that it delivered to appellant a car of corn, to be shipped from Waco to Barnum, Tex.; that appellant issued to it a through bill of lading, under the terms of which it agreed to transport said car to said destination; that the car of corn was accepted by the connecting carriers under said through waybill; and that each of the connecting carriers recognized, acquiesced in, and acted upon, same.
