This is the second appeal in this case. The opinion of the court on the first appeal is reported in (Tex. Civ. App.) 37 S.W.(2d) 823. The suit was instituted hy appellee, J. H. Killingsworth, against appellant, General Motors Acceptance Corporation, and Hearne-Wilson Chevrolet Company, hereinafter called Chevrolet Company, both corporations, to recover both actual and exemplary damages for the conversion of his automobile.
