This consolidated case comes before the court on defendant’s second motion for summary judgment and plaintiffs opposition thereto. Plaintiff has petitioned this *240court for damages resulting from an alleged breach of contract by the Department of Housing and Urban Development (HUD).1 Defendant first moved for summary judgment on grounds that plaintiffs petitions failed to state a claim on which relief could be granted and that, even if HUD officials did purport to make the agreements alleged by plaintiff, they were acting beyond the scope of their legal authority.
