OPINION

This is an action for declaratory judgment brought by plaintiff, a city fireman formerly a member of the City of Springfield Fire Department. Plaintiff was dismissed for cause from the Springfield Fire Department and seeks to establish his right to a refund of contributions made by him to the Firemen’s Pension and Relief Rund during the period he served as such fireman.
