The Plaintiff, Datron, Inc. (“Datron”), commenced this action against the Defendant, CRA Holdings, Inc. (“CRA”), to recover damages for the alleged contamination of certain real property it purchased from CRA. Datron asserts CRA is hable for clean up costs pursuant to: (1) an indemnification provision contained in the sales agreement between the parties; and (2) § 107 of the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. § 9601 et seq.
