MEMORANDUM OPINION AND ORDER

FULLER, District Judge.

I. INTRODUCTION

Johnny Sanders (hereinafter “Sanders”) has brought this lawsuit pursuant to feder al anti-discrimination statutes against his former employer the City of Montgomery contending that it discriminated against him on the basis of his race and retaliated against him for protected conduct. Sanders’ suit also set forth a claim against the City of Montgomery pursuant to Alabama law for negligence in its management of the landfill and its staff.
