Plaintiff brought this action against defendant, its liability insurer, arising out of defendant’s defense of plaintiff in an underlying tort action and, in particular, defendant’s failure to settle that action within the limits of its coverage. Plaintiff asserted claims for breach of contract and breach of fiduciary duty. Judgment was entered for it on a verdict that awarded compensatory damages on both claims and punitive damages on the tort claim.
