PTIBMAN, PRESIDING Judge.

Being prosecuted in the district court of McClain county by information for the crime of murder, petitioner, John Ingles, on the 16th day of February, 1911, filed with the cleric of said court an application for a change of judge, alleging, in substance, that the respondent, Hon. B. McMillan, the regular judge of said court, was so biased and prejudiced against the petitioner that petitioner could not have a fair and impartial trial in said court before said respondent.
