On the 3rd day of November, 1909, the defendant was convicted in the county court of Adair county of the offense of selling whisky. On the 6th day of November, 1909, defendant applied to this court for a writ ofhabeas corpus, alleging that he was in the custody of the sheriff of Adair county by virtue of such conviction, and that the conviction was illegal for want of jurisdiction of the county court to try said cause upon the ground that before the beginning of the trial the defendant had filed in said court his affidavit, alleging that the county judge who was presiding at said trial was so…
