The defendant appeals from a judgment in favor of the plaintiff. The complaint is in four counts. The only controversy concerns the first and the third counts, each of which covered the same demand.

The plaintiffs were attorneys at law and partners in the practice of law. The defendant was the owner as tenant in common with S. W. Slinkard and Laura Slinkard, his wife, of 160 acres of land and certain crops and other personal property used on the land in connection with its cultivation, the defendant having eleven-sixteenths interest therein and the Slinkards five-sixteenths interest.
