This case is before us on certificate from the Judge Advocate General of the Army pursuant to Article 67(b)(2), Uniform Code of Military Justice, 10 USC § 867(b)(2).

The decision of the US Army Court of Military Review which we are called upon to review reversed and set aside the instant special court-martial conviction of the accused for unauthorized absence in violation of Article 86, UCMJ, 10 USC §886, and authorized a rehearing.
