In these consolidated cases, several hospitals contest the legality of a rule promulgated by the Department of Health and Human Services 1 (HHS) to reimburse hospitals for malpractice insurance premiums stemming from the treatment of Medicare patients. The District Court, hearing the case on “certified review” from HHS’s Provider Reimbursement Review Board (PRRB), held that the Secretary’s actions were within the scope of her broad discretion. 573 F.Supp. 884 (D.D.C.1983).
