Defendant Etihad Airways P.J.S.C. (“defendant”) moves pursuant to Federal Rule *701of Civil Procedure 12(b)(6) to dismiss Counts I, II, and III of plaintiff Martyn Baylay’s Second Amended Complaint on the basis that these three counts are barred by the exclusivity provisions of the Illinois Workers’ Compensation Act (“IWCA”) [33].
