— After the jury had brought in a verdict for the plaintiff, and answered certain special issues submitted *35at the request of the defendant, both sides moved for judgment— plaintiff upon the general verdict, and defendant upon the answers to the special issues. The court denied the defendant’s motion, and granted that of plaintiff. Upon that judgment was entered, and defendant appeals.
