HOLLOWAY, Circuit Judge.

Plaintiff-Appellee-Cross-Appellant Guillermo Sanjuan (“Sanjuan”) filed suit on December 12, 1994, in the United States Dis trict Court for the District of Kansas against Defendant-Appellant-Cross-Appellee IBP, Inc. (“IBP”), alleging that IBP terminated Sanjuan’s employment in retaliation for San-juan’s work-related injury. The district court had diversity jurisdiction of the case pursuant to 28 U.S.C. § 1332. The case was tried before a jury, which found in favor of Sanjuan. Both parties filed post-trial motions, all of which were denied by the district court.
