Currently before the Court are the Third Party Defendant’s Motion to Dismiss (Doc. 8), Amended Motion to Dismiss *638(Doc. 9) and brief in support (Doc. 10) as well as the Third Party Plaintiffs’ Response to the Amended Motion to Dismiss (Doc. 13), and brief in support (Doc. 14). The Third Party Defendant moves to dismiss the Third Party Complaint (Doc. 6) for failure to state a claim upon which relief may be granted. Fed.R.Civ.P. 12(b)(6). For the reasons stated below, the Amended Motion to Dismiss (Doc. 9) is DENIED.
