ORDER DENYING MOTION TO DISMISS

This matter is before the Court upon Defendant’s Motion to Dismiss Count II of the Complaint. Plaintiff has filed a memorandum in opposition to the motion. For the reasons stated herein, Defendant’s motion is DENIED.

Plaintiff brought this action alleging age based employment discrimination in March of 1981. The first cause of action stated a claim under Section 7 of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 626(b).
