In June 1987, plaintiff-appellant Sean L. Hao (Sean) was seriously injured in a motorcycle racing accident at Hawaii Raceway Park (HRP). Following the accident, Sean and his parents (collectively the Haos) filed a complaint in the Circuit Court of the First Circuit, State of Hawaii, alleging, inter alia, negligence on the part of defendant-appellee Campbell Estate. 1 Campbell Estate moved for summary judgment on the ground that, as owner and lessor of the land on which HRP was located, it owed no legal duty of care to the Haos.
