Currently pending before the Court is Plaintiffs Memorandum in Support of Mo tion to Exclude Evidence of Disability Payments, or in the alternative to Certify a Question to the West Virginia Supreme Court of Appeals. Defendant has filed a brief in opposition to Plaintiffs Motion and opposes the requested certification to the West Virginia Supreme Court as well.
