This action was to recover for personal injuries alleged to have been received by respondent, and damages to his Ford automobile truck, as a result of a collision between such truck and one of the electric interurban cars owned by the appellant rail*97way and, at the time, operated by the appellant Nelson.
The accident occurred on April 15,1921, at the intersection of Phinney avenue and North 47th street, in Seattle.
