The plaintiff, Thomson, seeks recovery of damages for personal injuries claimed as the result of being struck by one of the city’s street cars while it was being negligently operated by one of the city’s employees. The case proceeded to trial in the superior court for King county, sitting with a jury. By appropriate motions made at the close of the plaintiff’s evidence and at the close of all of the evidence, counsel for the city challenged the sufficiency of the evidence to sustain any recovery by Thomson.
