MEMORANDUM OPINION AND ORDER

NORDBERG, District Judge.

Before the Court is Defendant Zenith Laboratories’ Motion to Dismiss pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure and Motion for an Award of Attorney Fees and Expenses.

I. BACKGROUND

Plaintiff Abbott Laboratories (“Plaintiff’), in Count I of its Complaint dated June 5, 1995 (“Complaint”), has brought a patent infringement action against Defendant Zenith Laboratories (“Defendant”) pursuant to 35 U.S.C. § 271(e)(2)(A).
