MEMORANDUM AND ORDER

YOUNG, District Judge.

The Plaintiff, Amgen, Inc. (“Amgen”), brings this action against the Defendants, Hoechst Marion Roussel, Inc. (“Hoechst”) and Transkaryotie Therapies, Inc. (“Tran-skaryotie”) (collectively “the Defendants”), alleging patent infringement. Amgen holds several patents covering a recombinant (genetically engineered) form of erythropoietin (“EPO”), a hormone that stimulates the body’s production of red blood cells.
