Appellant sued the appellee to recover damages for personal injuries alleged to have been received by the negligence of the latter. Appellee is engaged in the manufacture of freight and passenger-cars, and, among many other machines and appliances, has a device for crushing old car wheels preparatory to melting and remoulding, which device, or machine, is constructed as follows: There are four upright heavy timber posts set in a'square of ten feet, twenty-five feet high, slightly inclined to the center point at the top.
