— This was an action for a personal injury alleged to have been sustained by the appellant while in the employment of the appellee in consequence of the neglect *150of the appellee to perform a statutory duty owing to him. A demurrer to the complaint for the insufficiency of the facts stated .was sustained, and, the appellant refusing to amend, judgment was rendered against him. The ruling on the demurrer is assigned for error.
