The defendant, William Geer, is appealing from a conviction for rape.

The defendant and the prosecuting witness had been acquainted for a number of years. Shortly after midnight on November 3, 1973, Geer gained entry into the victim’s home by breaking a window in order to unlatch the door. She confronted him in the entryway to the living room. Geer acted very strangely and was apparently intoxicated. He claimed that someone was after him. The victim conversed with him for a time in an effort to further ascertain his difficulty.
