The defendants in error were the plaintiffs below, and the plaintiff in error was the defendant; and for convenience the parties will be referred to herein as plaintiffs and defendant, as they appeared in the trial court.

The plaintiffs allege in their petition that they are partners, and residents of the state of Texas; that on or about the 13th day of April, 1919, they made a contract with the defendant to sell and assist in selling Duplex motor trucks in the vicinity of Albany, Tex.: that they were to have as commission ten per cent, of the sale price of such trucks…
