After plaintiff, Robert B. Campbell (“Campbell”), failed to gain the necessary certification that he was physically qualified under controlling federal standards for employment as an operator of a commercial motor vehicle, he instituted this lawsuit against his prospective employer, defendant Federal Express Corporation (“Federal Express”), alleging disability discrimination in violation of the Americans with Disabilities Act (“ADA”), 42 U.S.C.A. § 12101 et seq.
