Defendant, Bobby Gene Bare, and Yolanda Cooley had a daughter, Winter Bare, in February 1983. In August 1983, they were living in Ashe County, North Carolina, when Yolanda signed papers making defendant the legal guardian of Winter Bare; Yolanda then moved to Kentucky to work for the Job Corps. Defendant stayed in contact with Yolanda, tried to convince her to move back to North Carolina and proposed marriage, but Yolanda declined.
