WOOLLEY, Circuit Judge.

This action was brought on a policy of accident insurance by the widow of the insured, who, in the event of her husband’s death by accident, was the designated beneficiary. The defendant admitted the execution and delivery of the policy, but for defense maintained, that the policy had expired before the accident and had not been renewed; or if renewed, the failure of the insured to pay the renewal premium before the accident, relieved it of liability, and that a premium subsequently paid merely reinstated the policy as to injuries thereafter sustained.
