On February 13, 1997 plaintiff, presently incarcerated at the Federal Correctional Institution in Butner, North Carolina, filed a pro se action alleging an Eighth Amendment violation of his right to medical and mental health treatment at the hands of numerous prison officials and health care providers at the Federal Correctional Institution in Cumberland, Maryland. 2 Although plaintiff captioned his civil rights action as one arising under 42 U.S.C.
