OPINION

KELLAM, District Judge.

Plaintiffs seek judgment declaring and adjudicating their rights under a lease made May 1, 1952 by their predecessors in title with Commissioned Officers’ Beach Club, Virginia Beach, Virginia. The facts alleged in the original and amended motions are admitted. The parties agree there is no evidence which they can present which will assist the Court in deciding the issue. Each of the parties has moved for summary judgment.

Briefly stated, Richard J. Davis and Jean M. Davis, husband and wife, leased ten vacant lots in Virginia Beach to the aforesaid officers’ club,…
