MEMORANDUM OF OPINION AND ORDER DENYING PLAINTIFF’S MOTION FOR A PRELIMINARY INJUNCTION

This case is now before the Court on a motion for a preliminary injunction filed by plaintiff, The Extracorporeal Alliance, L.L.C. (“Alliance”). (Docket #3). This Court conducted an evidentiary hearing on plaintiffs motion on 28 August 2003, with counsel and parties present.
