STEPHENS, Circuit Judge.
This is an appeal from a judgment of the United States District Court dismissing the plaintiff’s complaint and entering a judgment that the plaintiff take nothing by his action, after demurrers to the fourth amended complaint had been sustained without leave to amend. The action was commenced in the Superior Court of the State of California and was removed to the District Court on the ground of diversity of citizenship.
