The majority argues that Plaintiffs-Midwest Media Property, L.L.C. (“Midwest”), CTI Properties, L.L.C. (“CTI”), and Speckert, L.L.C. (“Speckert”), lack standing to bring this action, under 42 U.S.C. § 1983, against Defendant Symmes Township (“Defendant” or “Township”), a municipality in Ohio. This result rests on the erroneous conclusion that Plaintiffs “chose[ ] not to challenge the size and height regulations” imposed by Defendant. Maj. Op. at 461.
